Simple, clear cut, and right. Period.

But, in the absence of any feedback, I'm just going to keep firing away at what I think is important and illustrates my point that there is something amiss in our country. so here goes....

terror trials in NYC - one of the most ridiculous decisions ever. clearly based on a lack of understanding between what falls in the civilian arena and the military arena. and yet another example of why I think there needs to be fundamental change in the way in which our country serves in the military.

There are so many things wrong with this situation I could go on for days - We captured KSM in a military/CIA raid in Pakistan. He is not an American citizen. He and his organization - Al Qaeda - had already declared war on the United States.

So - How can you possibly try him in a civilian court? When did he get mirandized? What evidence can be offered up that is not top secret, that does not expose our intelligence gathering techniques? What happens to the jurors and judge in the case? Why expose NYC to a security nightmare when you don't have to? Why subject the 9/11 families to the pain of a trial in open court? Why allow KSM and his fellow terrorist to have a forum in which they can expouse their evil beliefs and try to recruit more jihadists?

How bout this one - if KSM and the other four terrorist deserve a civilian trial, why is the government going to try other terrorists by military tribunals? Why one system for some of the enemy and different type of justice for others? Why the difference?

More questions - is KSM presumed innocent until proven guilty? The Attorney General is acting like his conviction is a fore gone conclusion. Doesn't that mean the defendent is not getting a free and fair trial? Doesn't that mean the system is rigged for a conviction? If so, what is the point of going through this kafkaesque exercise?

Still more - If KSM is presumed innocent until proven guilty and if he was "arreseted" in Pakistan, why is our government - through the military and CIA - actively launching Predator drone missile attacks that kill terrorists and civilians in the remote parts of Al Qaeda's hide outs in Pakistan? Isn't our government committing murder? Aren't we killing these people without giving them their day in court?

You see how ridiculous the mental gymnastics have to be in order to try to justify this decision.

In my eyes, this is yet another display of decision-making by those who fail to understand the nature of war because they never have served in war.

And, again, this is not only a problem with the current administration. The Bush administration and the Republican-held Congress at the time completely mishandled this situation from the get-go by not officially issuing a declaration of war against Al Qaeda, at least, and perhaps Afghanistan more broadly (since the ruling government of Afghanistan at the time was the Taliban and they gave save harbor to Al Qaeda and allowed them to plan and prepare for the attacks.)

By declaring war, it would have made things clear cut - our nation is at war and those we capture in the course of this war are held as military combatants and these combatants shall be brought to justice - i.e. executed - by the military.

Simple, clear cut, and right. Period.

ps - if you can tell, I am done pulling punches. (feel free to agree or disgaree with my assessment.)
